Town of East Brookfield seeks Corps of Engineers permit to retain, maintain dam on Five Mile River in North Brookfield

Published April 26, 2011

CONCORD, Mass. – The Town of East Brookfield is seeking a permit from the U.S. Army Corps of Engineers to conduct work in waters of the United States in conjunction with retaining and maintaining a dam on the Five Mile River in North Brookfield, Mass.

The permit applicant proposes to retain and maintain a check dam on the Five Mile River. Work is proposed in Lake Lashaway/Five Mile River off of Harrington Street/Shore Road in East Brookfield/North Brookfield. The check dam provides a mechanism to control the flow and water elevation of Five Mile River during the annual drawdown of Lake Lashaway.

The new dam provides additional safety for workers when opening and closing the structure. The dam will be raised between May 1 and May 31 and lowered between Oct. 1 and Oct. 31, dependent on weather variations. The original dam was permitted by the Corps under permit number MA-KABR-82-310 and modified on Sept. 13, 1983. The original permit allowed for a drawdown after Oct. 1 with a stable low water elevation reached by Dec. 15 and required that re-flooding is completed by March 1. It was then amended to allow for drawdown to happen after Sept. 20.

The application for the federal permit was filed with the Corps of Engineers in compliance with Section 404 of the Clean Water Act, which regulates the discharge or fill of material in U.S. waters, including wetlands. The Corps public notice, with more detailed information on the proposed project, can be reviewed online at the Corps website http://www.nae.usace.army.mil. Select Regulatory/Permitting and then weekly public notices and search by file number or state.

Public comments on the Corps permit review (File # NAE-2006-2427) should be forwarded no later than May 26, 2011 to the U.S. Army Corps of Engineers, New England District, Regulatory Division (ATTN: Richard Kristoff), 696 Virginia Road, Concord, MA 01742-2751.

Additional information is available from Permit Project Manager Richard Kristoff at 978-318-8171 or toll free 800-343-4789 or 800-362-4367 (if calling from within Massachusetts) or by email to: richard.c.kristoff@usace.army.mil.
